Apex Glass Industries — Terms of Service

Welcome to Apex Glass Industries. By accessing, browsing, or using our website (apexglassindustries.com), or by purchasing our products and services, you agree to comply with and be bound by the following Terms of Service.

1. General Information

  • Apex Glass Industries specializes in custom glass fabrication, installation, and the supply of hardware and glass systems.

  • All content on this website, including text, graphics, logos, and images, is the property of Apex Glass Industries and may not be copied, reproduced, or distributed without prior written consent.

2. Products & Services

  • Custom Glass:
    All glass products—including shower enclosures, railings, partitions, and panels—are custom fabricated based on project specifications, field measurements, and approved details.

  • Hardware & Glass Systems:
    We offer both standard and custom hardware and glass systems, including material-only orders available for shipment or delivery.

  • Apex Glass Industries reserves the right to update product specifications, pricing, and availability without prior notice.

3. Orders & Payments

  • Orders are considered confirmed once a deposit or full payment has been received.

  • Approval of a quote or invoice, or written or verbal confirmation (including email or text), constitutes authorization to proceed with the order and associated pricing.

  • Payments may be made via Zelle, check, credit card, or other approved methods. A processing fee may apply to credit card transactions.

  • Orders will not enter production or procurement until payment is received and cleared.

4. Custom Fabrication & Final Sale

  • Due to the custom nature of glass fabrication, all products are non-returnable and non-refundable once production or procurement has begun.

5. Cancellations

  • Orders may be cancelled within 24 hours of payment, provided fabrication or procurement has not begun.

  • Once fabrication or procurement has started, cancellations are not permitted, and all payments made are non-refundable.

6. Returns & Refunds

  • Due to the custom nature of glass fabrication, all sales are final and non-refundable once production or procurement has begun.

  • Limited exceptions may apply for verified defects or order discrepancies, as outlined in our Return & Refund Policy.

  • Any approved refunds will be processed within 10–15 business days.

7. Delivery, Installation & Risk of Loss

  • Material-Only Orders: Delivery to the address provided by the purchaser constitutes fulfillment of the order. Responsibility for materials transfers to the purchaser upon delivery.

  • Installation Projects: Clients are responsible for ensuring site readiness and safe access for installation. Completion is defined as installation of the agreed scope and operable functionality of the system.

  • Apex Glass Industries is not responsible for delays caused by site conditions, carriers, weather, or factors beyond our control.

 

8. Measurements & Field Conditions

  • Final fabrication is based on field measurements and site conditions at the time of measurement. Structural elements, wall conditions, and finishes may affect fit and may require adjustments.

 

9. Warranty

  • Apex Glass Industries provides a five (5) year warranty on workmanship from the date of installation, covering installation-related defects under normal use.

  • Manufacturer warranties apply to glass and hardware where applicable.

  • This warranty does not cover damage caused by misuse, improper cleaning, normal wear, structural movement, third-party handling, or modifications made after installation.

  • Warranty coverage applies only to the original installation and is non-transferable.

 

10. Chargebacks & Payment Disputes

  • By submitting payment, the purchaser confirms they are the authorized cardholder and approves the transaction.

  • The purchaser agrees to contact Apex Glass Industries directly to resolve any concerns prior to initiating a chargeback or payment dispute.

  • Unauthorized chargebacks for completed work or delivered materials may be subject to recovery efforts, including collection actions where permitted by law.

 

11. Site Use

By using our website, you agree not to:

  • Misuse the site or attempt unauthorized access

  • Use our services for unlawful purposes

  • Reproduce or distribute content without permission

12. Limitation of Liability

  • To the fullest extent permitted by law, Apex Glass Industries shall not be liable for indirect, incidental, or consequential damages arising from the use of our products or services.

  • 13. Indemnification

You agree to indemnify and hold harmless Apex Glass Industries, its employees, and contractors from any claims, damages, or expenses arising from the use of our products or services.

14. Governing Law

  • These Terms of Service are governed by the laws of the State of Georgia. Any disputes shall be resolved in the courts located in Fulton County, Georgia.

15. Changes to Terms

Apex Glass Industries reserves the right to update these Terms of Service at any time. Continued use of our services constitutes acceptance of any updated terms.
